What to Expect After the Hearing

When you receive the hearing panel's decision, review it carefully. There will be a decision indicating which Article(s) or Rule(s) have been violated with the "Findings of Facts" to support the decision. Additionally, there will be a "Recommendation of Hearing Panel Disciplinary Action" which will state the recommended discipline for each of the Respondents.

Findings of Fact are the conclusions of impartial panel members based on their reasoned assessment of all of the evidence and testimony presented during the hearing. Findings of Fact are not appealable.

If you believe the hearing process was seriously flawed to the extent you were denied a full and fair hearing, there are appellate procedures that are available to you. The decision of the hearing panel is not appealable.

A rehearing is generally granted only when newly discovered evidence comes to light:

  1. Which could not reasonably have been discovered and produced at the original hearing, and
  2. Which might have had a bearing on the hearing panel's decision.

The only grounds for a review by the Board of Directors is:

  1. The misapplication or misinterpretation of one or more Articles of the Code of Ethics or MLS Rules.
  2. A lack of due process
  3. Unwarranted or excessive discipline
