Filing a Disciplinary Complaint
The following information and form will assist you in filing a Disciplinary Complaint. If you need help or have other questions, contact Pam Barnes, Professional Standards Administrator at (925) 730-4074 or pamb@bayeast.org
In order for the Association's Grievance Council to review an alleged ethics or MLS violation, Grievance Complaint form (D-1) must be filled out and returned to the Association (See bottom of page).
In filling out both forms (see below for link to forms), please note the following:
- Write in your name as the complainant.
- Write in the name(s) of the respondent (the person against whom the complaint is made). You MAY include the name of the Responsible Broker or Participant for an alleged violation of the Code of Ethics and/or violation of the MLS Rules & Regulations.
- Be sure to specify which violation(s) of the Code of Ethics or Section(s) of the MLS Rules and Regulations you are citing by writing the Article(s) or Section(s) number. In identifying the item(s) please read the Articles carefully. Place the Article or Section number(s) in the proper space.
- Attach a typed statement and documentation supporting the charge(s). This will be marked "Exhibit 1" (Documentation may include copies of contracts, deposit receipts, written communication, supporting evidence).
- Is this complaint currently in litigation?
- Has a complaint been filed with the California Department of Real Estate?
Once all the necessary information is received by the Association, it will be reviewed by the Grievance Committee. You will be notified by mail of their determination as to whether or not a formal hearing will be scheduled.
